IMPORTANT NOTICE: THESE TERMS REQUIRE DISPUTES TO GO THROUGH MEDIATION AND THEN BINDING INDIVIDUAL ARBITRATION, AND INCLUDE A WAIVER OF CLASS ACTION RIGHTS, AS DESCRIBED IN SECTION 19. YOU MAY OPT OUT OF ARBITRATION WITHIN 30 DAYS.
These Terms of Service ("Terms") are an agreement between you and BeachFox Software LLC ("we," "us," or "our"). They govern your use of TUFF Fantasy Football, including our website, mobile apps, and related services (the "Service").
By checking the box to agree, creating an account, or using the Service, you accept these Terms and our Privacy Policy. If you do not agree, do not use the Service.
We may update these Terms from time to time. If we make material changes, we will notify you by email or in the app at least 14 days before they take effect. Continuing to use the Service after changes take effect means you accept the updated Terms.
You must be at least 18 years old, or the age of majority where you live if that is older, and able to form a binding contract to use the Service. By creating an account or using the Service, you confirm that you meet these requirements. We do not verify the age of users. If we learn that a user does not meet these requirements, we may close their account.
The Service is not directed to children under 13, and we do not knowingly collect their personal information.
You must provide accurate information when you create an account and keep it up to date. You are responsible for keeping your password secure and for all activity under your account.
Notify us right away at support@tuff.football if you believe your account has been accessed without your permission. Each person may hold only one account, and accounts may not be sold or transferred.
The Service lets users create and join private fantasy football leagues. Leagues are not open to the public; members join only by invitation from the league's commissioner. Each league may have up to 20 teams.
The person named as commissioner when a league is bought is its commissioner for that season. The commissioner role is held one season at a time, and a league may have more than one commissioner ("co-commissioners"). A commissioner may make any manager in the league a co-commissioner for that season.
Every league plays under the same scoring system, player salaries, salary cap, trade allowances, roster requirements, and official rules. We set these for all leagues, and commissioners cannot change them. Commissioners manage their own league, including its name and avatar; its membership, including inviting, editing, and removing managers; its entry fee, prize money, and dues records; and the other league options offered in the app. The app checks and applies every trade under the league rules. Commissioners may enter, change, or cancel trades on a manager's behalf subject to those rules, and may set rosters before the league's first week is played.
We are not responsible for commissioner decisions and do not settle disputes between league members. Any disagreement over league outcomes must be resolved within the league.
Creating a league for one NFL season costs $139 (the "League Fee"), paid by the commissioner or another member on the league's behalf. For the 2026 season only, new leagues start in Week 5 of the NFL regular season and the League Fee is $99. The League Fee covers one league, up to 20 teams, for one regular season and fantasy playoffs. League members who do not pay the League Fee may use the league at no charge.
Payments are processed by Stripe. We do not store full card numbers. Prices are shown before purchase and may change for future seasons, but a price change will not affect a season you have already paid for.
League Fees do not renew automatically. Each new season requires a new purchase.
You may request a full refund of the League Fee at any time before the first game of your league's first week kicks off by contacting support@tuff.football. For leagues bought for the 2026 season, that is the first game of Week 5 of the NFL regular season; for later seasons, it is the first game of Week 1. Once that game has started, League Fees are non-refundable, except where required by law or where the Service is unavailable for an extended period due to our fault.
A full refund deletes the league. Its teams, rosters, trades, settings and records are permanently removed, for every member of the league. Members' accounts are not affected. We keep a record of the purchase and the refund.
League Fees are sold only through our web app. Approved refunds are returned to the original payment method.
The Service is league management software. We do not collect, hold, transfer, or distribute league dues, prize money, or wagers between league members, and we do not guarantee any payment between members. The League Fee is a fee for software only and is never part of any prize. The Service includes a league dues tool that lets commissioners record the dues each team owes, payments made, and balances. This tool is for record-keeping only. Entries in it are made by league members, and we do not collect, hold, or verify any payment shown there.
Any money arrangements within a league are solely between its members. You are responsible for knowing and following the laws that apply to you, which vary by state and country. We make no statement that any such arrangement is legal where you live.
Player statistics, news, and injury information come from third-party providers. This data may be delayed, incomplete, or corrected after games end. Scores in the Service update to reflect official corrections.
Scores for each week become final at 11:59 p.m. Eastern Time on the Wednesday after the week's last game. After that, we will not change results for later stat corrections, except at the commissioner's direction. We are not responsible for losses or disputes caused by data errors, delays, or corrections.
TUFF Fantasy Football is not affiliated with, endorsed by, or sponsored by the National Football League, any NFL team, the NFL Players Association, or any player. All team names, logos, and trademarks belong to their respective owners.
You agree not to:
You keep ownership of content you post, which is limited to league names, team names, and the league, team, and profile avatar images you upload ("User Content"). You give us a non-exclusive, royalty-free license to host, display, and process your User Content only as needed to operate the Service.
You are responsible for your User Content and confirm you have the right to post it. Do not upload images you do not have permission to use, such as NFL or team logos, or photos of other people without their consent. We may remove User Content that violates these Terms. We do not review all User Content and are not responsible for it.
The Service, including its software, design, and trademarks, belongs to BeachFox Software LLC and its licensors. These Terms give you a limited, personal, non-transferable right to use the Service for your own leagues. They do not transfer any ownership to you.
The TUFF format. The Official Rules, the TUFF Scoring System, player salaries, salary caps, and trade allowances, as provided in the Service (together, the "TUFF Format"), are made available to league members only, for use in their own leagues on the Service. You agree not to copy, publish, post, distribute, or otherwise share the TUFF Format, in whole or in substantial part, with anyone outside your league, and not to use it to create, run, or help run any fantasy sports game, league, or service other than through the Service. This applies while you use the Service and after your account closes. Discussing your own league, its results, and your own team is not restricted.
If you send us feedback or suggestions, we may use them without any obligation to you.
You may close your account at any time from your account settings or by contacting support@tuff.football. We may suspend or close your account if you violate these Terms or if required by law. Where reasonable, we will give notice first.
If a commissioner closes their account, they may hand the commissioner role to another member of the league. If they do not, the role stays with any co-commissioner; if there is none, we will act as the league's commissioner, and any member of the league may ask to take over the role by contacting support@tuff.football. League Fees are not refunded when an account is closed for violating these Terms. Sections 8, 9, 12, 13, and 16 through 20 survive termination.
We work to keep the Service running, especially on game days, but we do not guarantee it will be uninterrupted or error-free. We may perform maintenance, change features, or experience outages. We are not responsible for missed roster changes, trades, or trade deadlines caused by downtime, network problems, or device issues.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT ALLOWED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT STATISTICS, SCORES, OR OTHER DATA ARE ACCURATE OR TIMELY.
TO THE FULLEST EXTENT ALLOWED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, OR LOST WINNINGS OR WAGERS, ARISING FROM YOUR USE OF THE SERVICE.
OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE LEAGUE FEES YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) $50. Some jurisdictions do not allow these limits, so they may not apply to you.
You agree to defend and hold harmless BeachFox Software LLC and its officers, employees, and agents from claims, losses, and expenses, including reasonable attorneys' fees, arising from your User Content, your violation of these Terms or the law, or any money arrangement within a league you belong to.
Disputes are resolved in three steps: informal resolution, then mediation, then binding arbitration, except for the claims described under "Exceptions" below.
Step 1: Informal resolution. Before starting mediation or arbitration, you agree to contact us at support@tuff.football, describe the dispute and the relief you want, and try to resolve it informally for at least 30 days. We will do the same before bringing a claim against you.
Step 2: Mediation. If the dispute is not resolved within 30 days, either party may begin non-binding mediation by sending written notice to the other. Mediation will be administered by JAMS under its mediation procedures and will take place by video conference unless both parties agree otherwise. We will pay the mediator's fees and JAMS's mediation fees; each party pays its own attorneys' fees. Anything said or offered during mediation is confidential and may not be used as evidence in any later proceeding. If the dispute is not resolved within 60 days after the mediation notice, or a longer period both parties agree to, either party may begin arbitration.
Step 3: Binding arbitration. If a dispute is not resolved through mediation, either party may begin binding arbitration, which will be the only way to resolve it. This covers all claims arising out of or relating to these Terms (including their formation, performance, and breach), your relationship with us, or your use of the Service. Arbitration will be administered by JAMS under its rules and its consumer arbitration minimum standards, excluding any rules that would allow class or representative proceedings.
The arbitrator, not a court, will decide all questions about the interpretation, scope, enforceability, or formation of these Terms, including whether a claim must be arbitrated. The arbitrator may award any relief that a court could award, and the written award may be entered as a judgment in any court with jurisdiction. You understand that without this section you would have the right to sue in court and have a jury trial, and that discovery in arbitration may be more limited than in court.
Arbitration costs. If the JAMS filing fee is more than the fee to file a lawsuit in court, we will pay the difference. If the arbitrator finds that your claim is not frivolous, we will pay all JAMS filing and arbitrator fees for claims up to $75,000. JAMS rules may also allow you to recover attorneys' fees in some cases.
Location. If you live in the United States, the arbitration will take place at a reasonable location in the United States that is convenient for you, or by video or phone if both parties agree.
Class action waiver. You and we may bring claims against each other only individually, and not as a plaintiff or class member in any class, collective, or representative proceeding. If a court or arbitrator decides that this class action waiver is unenforceable, or that an arbitration can proceed on a class basis, the arbitration step of this section will be void, and the dispute will be resolved in court as described below.
Exceptions. Either party may bring an individual claim in small claims court if it qualifies, without first going through mediation. Either party may also go directly to a state or federal court, without first going through mediation or arbitration, to seek a temporary restraining order, an injunction, or other equitable relief to protect its intellectual property rights (patents, copyrights, trademarks, and trade secrets, but not privacy or publicity rights) or its confidential information, including to stop unauthorized access to the Service, its systems, or its data. "Confidential information" means non-public information about the Service, including its software, security, and systems, the TUFF Format described in Section 13, and the personal information of other users.
30-day right to opt out. You may opt out of the arbitration step of this section and the class action waiver by sending written notice within 30 days of first accepting these Terms, either by mail to BeachFox Software LLC, Attn: Arbitration Opt-Out, PMB 931221, 5540 Centerview Dr Ste 204, Raleigh, NC 27606, or by email to support@tuff.football with the subject line "Arbitration Opt-Out." Include your name and the email address on your account. If you opt out, we will not be bound by the arbitration step either, and informal resolution and mediation still apply before either party goes to court.
Changes to this section. We will give at least 60 days' notice of any change to this Section 19. Changes take effect on the 60th day and apply only to claims that arise after that date.
Courts. Any dispute that is not subject to arbitration will be brought only in the state or federal courts located in Brunswick County, North Carolina, and you and we consent to their personal jurisdiction and venue.
These Terms are governed by the laws of the State of North Carolina, without regard to its conflict-of-law rules.
These Terms and the Privacy Policy are the entire agreement between you and us about the Service. If any part of these Terms is found unenforceable, the rest stays in effect. Our failure to enforce a provision is not a waiver of it.
You may not transfer your rights under these Terms. We may transfer ours in connection with a merger, acquisition, or sale of assets. We are not liable for delays caused by events beyond our reasonable control.
